Participant Waiver
Read it, sign it once, and you're covered for every Outside Club run for 12 months.
Participant Release, Waiver of Liability, Assumption of Risk and Indemnity Agreement
Please read carefully. By signing, you give up certain legal rights, including the right to sue.
1. The activity. Outside Club is a free, volunteer-led run and walk club organized by BAEPSAE and BAEPSAE SPORT ("BAEPSAE"). Activities include group runs, walks, hikes, fitness meetups and related social gatherings ("Events"), held on public streets, sidewalks, trails and parks that BAEPSAE does not own or control.
2. Eligibility. I confirm I am 18 or older. Participants under 18 may not take part.
3. Health and fitness. I am physically fit enough to take part and have no medical condition that makes participating unsafe. I have consulted a doctor if I had any doubt. I choose my own pace and distance, and I will stop if I feel unwell. No medical staff are present at Events.
4. Known risks. I understand that running, walking and outdoor exercise carry inherent risks, including but not limited to: falls, sprains, fractures and other injuries; heat exhaustion, heat stroke and dehydration, which are serious risks in Las Vegas; cardiac events; traffic, cyclists and scooters; uneven, wet or poorly lit surfaces; running in darkness; animals; weather; the actions of other participants, hosts or members of the public; and loss or theft of personal property. Risks may be caused by the negligence of the Released Parties.
5. Assumption of risk. I voluntarily assume all risks of taking part, known and unknown, even if caused by the ordinary negligence of the Released Parties.
6. Release and waiver. To the fullest extent allowed by law, I release, waive and agree not to sue BAEPSAE, its owners, members, managers, employees, contractors, volunteers, Flock Leaders and event hosts, sponsors and partners (the "Released Parties") for any injury, illness, death, loss or damage arising from my participation, including claims based on the Released Parties' ordinary negligence.
7. Indemnity. I agree to indemnify and hold harmless the Released Parties from any claims, costs or expenses, including attorney fees, arising from my conduct at Events or my breach of this agreement.
8. Medical treatment. If I am injured or ill and unable to consent, I authorize the Released Parties to call emergency services on my behalf. I am responsible for any resulting medical and transport costs.
9. Rules and conduct. I will follow host instructions, obey traffic laws, stay on the announced route and treat others with respect. BAEPSAE or any host may remove me from an Event or the club at any time.
10. Photos and video. I allow BAEPSAE to photograph and film me at Events and to use that footage in marketing, on social media and on baepsae.com, without payment, unless I tick the opt-out box below.
11. Electronic signature. Typing my name and submitting this form is my legal signature, with the same effect as signing on paper.
12. General terms. This agreement is governed by Nevada law. If any part is found unenforceable, the rest stays in effect. It covers every Event I attend for 12 months from the date I sign. This is the entire agreement on this subject.
